Predictive Company Limited ( the “Company”, “we”, “us” or “our”) recognizes the importance of the protection and maintaining privacy and security of your personal information which the Company may collect from our customers, website visitors under the Company’s responsibility (collectively referred to as “you”) Therefore, the Company established this Privacy Notice for Customer (“Privacy Notice”) to describe how we collect, use and disclose your personal data (“Data Processing”) including how we handle and protect such personal data to be in accordance with the Personal Data Protection Act B.E. 2562 (2019) (“Personal Data Protection Laws”). This Privacy Notice shall be solely applied to all information processing through this website and it shall not be applied to other information collected from the other sources.

This Privacy Notice and terms of use which are announced on the Company’s website stipulate rules and regulations in order to control the website operation which you must agree to, depending on the activities you have visited the Company’s website.

“Personal Data” means any information relating to a person which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased and juristic person.

Website Visitors
The Company may collect non-identifiable information from the web browser and server such as types of browser, language preferences, reference website and date and time of the visitors. The purposes of the collection are to understand website visitors and we may publish such information in general such as the report regarding the website usage trend.

The Company may collect personal data such as internet protocol addresses for logging in and commenting on the blog. The Company will disclose only internet protocol addresses of the users as well as using and disclosing personal data.

Sources of Personal Data
You may interact with the Company in a manner that the Company may obtain and collect your personal data which types of aggregated data are depending on communications and various channels as follows:

Minor
If you are under the age of 20 or having legal restrictions, we may require to obtain consent from your parents or legal guardian or any other responsible person according to applicable laws unless allowed by applicable laws. However, if we become aware that we have collected personal data from minors without verification of parental consent, we will take steps to remove that information from our servers without delay.

Retention period of Personal Data
The Company will retain your personal data for as long as necessary for the purposes set out in this Privacy Notice or when we deem it appropriate to retain such personal data as any applicable laws require or permit a longer retention period. However, we will erase, destroy, or anonymize your personal data when it is no longer necessary for providing our services or products to you or when the period permitted by applicable laws has lapsed.

    We may disclose certain personal data to business partners for the purposes specified under this Privacy Notice such as granting of benefits by our business partners.

We store your personal data on our company’s server in Thailand and a cloud system provided by our affiliate company and third party outside Thailand. Under certain circumstances regarding data transfer outside Thailand, we will implement security measures to ensure that your personal data is transferred to the destination country that provides adequate safeguard or other procedure as required by law to protect and maintain your personal data.

The website may contain links to other websites that are not owned or controlled by us. If you click third-party links, you will be directed to such third-party websites. We encourage you to read their privacy notice and terms and conditions of the websites you visit.

Please be aware that we are not responsible for the content, the privacy notices or the practice, products, services of third parties because the personal data protection will be in accordance with the privacy notice of such a website which is irrelevant to the Company.

Remarketing
The Company uses third-party remarketing services to advertise on the website (including Google, Facebook) to people who have previously visited the website which may appear in a form of the advertisement on Google Search Result or Google Display Network, Third-party Vendors (including Google, Facebook). The cookies shall be used to display advertisements relying on your previous visit and any information, which can be collected, shall be processed according to this Privacy Notice and Google’s Privacy Notice.

You are able to set Google to display the advertisement to you by setting up Google advertisement and you are able to opt-out the advertisement by setting up the cookies or using browser plugin.

Newsletter
The Company may use your personal data to analyze and improve the website, platform, product or service and conduct marketing activities through online channels such as Google, Facebook in order to offer products and services which are suitable to you for the benefit of the usage and we shall proceed after obtaining your consent.

We may send certain information or newsletter for the purpose of offering products or services that you may be interested in through your email or SMS. Subject to the PDPA, you may exercise any of these rights in the following:

Right to withdraw consent: If you have given consent to us to collect, use or disclose your personal data whether before or after the effective date of the Personal Data Protection Laws, you have the right to withdraw such consent at any time throughout the period your personal data is available to us. However, the withdrawal of consent shall not affect the processing of personal data you have already given consent to us legally.

Right to access: You have the right to access your personal data that is under our responsibility; to request us to make a copy of such data for you; and to request us to reveal how we obtain your personal data.

Right to data portability: You have the right to obtain your personal data if we organize such personal data in automatic machine-readable or usable format and can be processed or disclosed by automatic means; to request us to send or transfer the personal data in such format directly to other data controllers if doable by automatic means; and to request to obtain the personal data in such format sent or transferred by us directly to other data controllers unless not technically feasible.

Right to objection: You have the right to object to the collection, use or disclosure of your personal data at any time unless we have legitimate grounds to reject the requests.

Right to erasure or to be forgotten: You have the right to request us to erase, destroy or anonymize your personal data if you believe that the collection, use or disclosure of your personal data is against relevant laws; or retention of the data by us is no longer necessary in connection with related purposes under this Privacy Notice; or when you request to withdraw your consent or to object to the processing as earlier described.

Right to restriction of processing: You have the right to request us to suspend processing your personal data during the period where we examine your rectification or objection request; or when it is no longer necessary, and we must erase or destroy your personal data pursuant to relevant laws, but you request us to suspend the processing instead.

Right to rectification: You have the right to rectify your personal data to be updated, complete and not misleading.

Right to lodge a complaint: You have the right to complain to competent authorities pursuant to relevant laws if you believe that the collection, use or disclosure of your personal data is violating or not in compliance with relevant laws.

You may exercise these rights as the data subject under the PDPA by contacting us or our Data Protection Officer (DPO) as mentioned below. We will notify the result of your request within 30 days upon receipt of such request according to the method specified by the Company.

We reserve the right to amend this Privacy Notice from time to time and the amendment shall be at the Company’s sole discretion.
