Recruitment Privacy Policy

The Predictive Co., Ltd (“we”, “us”, or “our”) takes protection of personal data as an important matter in our businesses. This Recruitment Privacy Policy (“Policy”) describes how we collect, use and disclose personal data of job applicants, candidates and scholarship holders (“you” or “your”), and tells you about data protection rights in relation to your Personal Data in connection with recruiting procedures and programs.

Collection of Personal Data

As part of recruiting procedures and programs, we collect or obtain the following types of information which may include Personal Data about you during recruiting and job interview process, either submitted as part of the online application and/or through alternative channels e.g. job boards, company’s website and professional recruiting firm, Social Media, Job Fair, Networking events, etc. We may also collect your Personal Data from other sources or through our affiliates, subsidiaries, other companies, or business partners. The specific type of data collected will depend on the employment or services with us and within Predictive Co., Ltd

Personal Data: such as title, full name, marital status, date and place of birth, age, gender, military service, photograph, nationality, information on government-issued cards e.g. national identification card, passport, work permit, certificate, and any other licenses, signatures, CV, Resume, application form, bank account details and other identifiers;

Contact details: such as mobile phone number, present address, e-mail address, information on household registration document, emergency contact details, Line ID, LinkedIn URL, and include other similar information;

Information about your job: such as working experience and previous employment including position, department and title history and salary and benefits from previous employment, work behavior, your education history, training history, certificates and qualifications.

Sensitive Personal Data: such as health information, criminal records, religion and biometric data. We will only collect, use and disclose Sensitive Personal Data, and transfer it across borders, if we have received your explicit consent or as permitted by law.

If you provide Personal Data about members of your family, next of kin, references and/or other dependents for the purposes set forth in this Policy, it is your responsibility to inform them of their rights with respect to the contents of this Policy as applicable to them. You are also responsible for obtaining any required consent from them, and ensuring that you have the right to provide their personal information to us.

Use of Personal Data

We use the collected data for the purposes of recruitment management including documenting information collected from job applicants as part of the application process, authentication and verification, contacting purposes, evaluating the respective suitability of applicants, making a hiring decision, defining a salary and other basic contract information for a new hire, execution of employment agreement and orientation process, evaluating job applicants/ candidates for their qualification for a particular job, background screening (if you are offered a position with us), joining a program/project and communicating with your designated contacts in case of an emergency.

Disclosure of Personal Data

We may disclose or transfer your Personal Data to the following third parties who collect, use and disclose Personal Data in accordance with the purposes under this Policy. These third parties may be located in Thailand and areas outside Thailand. You can visit their HR privacy policy to learn more details on how they collect, use and disclose your Personal Data as you could also be subject to their privacy policies.

Predictive Group

We may disclose your personal data within our organization for administrations of employees and affiliated companies within Predictive Group collaborate and partially share employee services and systems including website-related services and systems and as part of our regular reporting activities, we may need to transfer your Personal Data to, or otherwise allow access to such Personal Data by other companies within Predictive Group for the purposes set out in this Policy.

Service Providers

We may also transfer or allow access to your Personal Data to our service providers for the purposes of training or seminars, IT services, recruiting process and professional services such as business consultants, recruitment agencies, auditors, legal firms, tax firms or any other advisors, etc.

Law Enforcement

In certain circumstances, we may be required to disclose or share your Personal Data in order to comply with a legal or regulatory obligation. This includes any law enforcement agency, court, regulator, government authority or other third party where we believe it is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, the rights of any third party or individuals’ personal safety, or to detect, prevent, or otherwise address fraud, security, or safety issues (e.g. the Royal Thai Police and the Ministry of Labour).

International Transfers

We may disclose or transfer your Personal Data to third parties or servers located overseas, which the destination countries may or may not have the same equivalent level of protection for Personal Data protection standards. We take steps and measures to ensure that your Personal Data is securely transferred and that the receiving parties have in place an appropriate level of data protection standards or other derogations as allowed by laws. We will request your consent where consent to cross-border transfer is required by law.

Your Rights as a Data Subject

Subject to the Personal Data Protection Laws thereof, you may exercise any of these rights in the following:

Withdrawal of consent: If you have given consent us to collect, use or disclose your Personal information whether before or after the effective date of the Personal Data Protection Laws, you have the right to withdraw such consent at any time throughout the period your personally-identifying information available to us, unless it is restricted by laws or you are still under beneficial contract.

Data access: You have the right to access your Personal information that is under our responsibility; to request us to make a copy of such data for you; and to request us to reveal as to how we obtain your Personal information.

Data portability: You have the right to obtain your Personal information if we organizes such Personal information in automatic machine-readable or usable format and can be processed or disclosed by automatic means; to request us to send or transfer the Personal information in such format directly to other data controllers if doable by automatic means; and to request to obtain the Personal information in such format sent or transferred by us directly to other data controller unless not technically feasible.

Objection: You have the right to object to the collection, use or disclosure of your Personal information at any time if such doing is conducted for legitimate interests of us, corporation or individual which is within your reasonable expectation; or for carrying out public tasks.

Data erasure or destruction: You have the right to request us to erase, destroy or anonymize your Personal information if you believe that the collection, use or disclosure of your Personal information is against relevant laws; or retention of the data by us is no longer necessary in connection with related purposes under this Privacy Policy ; or when you request to withdraw your consent or to object to the processing as earlier described.

Suspension: You have the right to request us to suspend processing your Personal information during the period where we examine your rectification or objection request; or when it is no longer necessary and we must erase or destroy your personally-identifying information pursuant to relevant laws but you instead request us to suspend the processing.

Rectification: You have the right to rectify your Personal information to be updated, complete and not misleading.

Complaint lodging: You have the right to complain to competent authorities pursuant to relevant laws if you believe that the collection, use or disclosure of your Personal information is violating or not in compliance with relevant laws.

We will notify the result of your request within 30 days upon receipt of such request. If we deny the request, we will inform you of the reason via email, telephone or registered mail (if applicable)

Data Retention

We will retain your Personal Data for as long as is reasonably necessary to fulfil the purpose for which we have obtained it, and to comply with our legal and regulatory obligations. Your Personal Data will, in any case, be retained for the duration of your employment or service relationship as well as thereafter as long as there are statutory retention obligations or potential claims resulting from the employment relationship are not yet time-barred.

Security

We endeavor to protect your Personal Data by establishing security measures in accordance with the principles of confidentiality, integrity, and availability to prevent loss, unauthorized or unlawful access, destruction, use, alteration, or disclosure including without limitation to administrative safeguard, technical safeguard, physical safeguard and access controls.

Data Breach Notification

We will notify the Office of the Personal Data Protection Committee without delay and, where feasible, within 72 hours after having become aware of it, unless such personal data breach is unlikely to result in a risk to the rights and freedoms of you. If the personal data breach is likely to result in a high risk to the rights and freedoms of you, we will also notify the personal data breach and the remedial measures to you without delay by website, SMS, email, telephone or registered mail (if applicable).
